Minutes for the
October 3, 2007 Meeting
The Zoning Board of Appeals was called to order by Chairman Al Schutte at 7:30 P.M. on October 3, 2007 in the Council Library. Attending were Chairman Al Schutte, members Dave Harwood, Lynn McCarthy and Tom Lippert. Member Mike Reed was absent. Applicants Tim Koetter and Art Sieder were present, along with Pam Morin, Building Department.
The following request was heard:

Request for a variance From Section 1266.11 of the Village of Evendale Zoning Code, prohibiting privacy fences in the Residential District

Tim Koetter explained that there are currently three pine trees that run from the back of their houses to the hill in the rear of their property. The trees provide privacy between the two properties. The trees are beginning to die and their root system is beginning to cause damage to the driveway. The applicants would like to remove the trees and put in a 30 linear foot, six foot high solid vinyl fence along the property line. They would choose a color of fence that would blend in and plant some landscaping to conceal the fence.
Al Schutte explained that Section 1266.11(a)(1) states that residential fences “shall have an open face area of not less than 70 percent.”
After a short discussion of the six justifications for granting a variance, the committee members agreed that the applicants did not show hardship nor special circumstances or conditions applying to their lot. Al Schutte made a motion to deny the variance, with Tom Lippert seconding the motion. The motion passed with the vote of 4 – 0.
Al Schutte explained the appeal process if they wished to pursue this variance. The committee members offered alternatives to the privacy fence, such as landscaping.
The minutes were approved with one correction, made on the motion of Al Schutte and seconded by Lynn McCarthy. A vote was taken and the motion passed with the vote of 4 – 0.
The meeting was adjourned at 7:50.
